1. Agreement

These terms are an agreement between you and Mykola Kobetiak ("we", "us") governing your use of the Nouri Baby iOS app. By installing or using the app you accept them. If you do not accept them, do not use the app.

2. What the app is

Nouri Baby lets you record feeds, diaper changes, sleep, weight, teeth and vaccinations for one or more babies, and read that information back as a timeline and as simple summaries. It can also estimate when your baby's next sleep is likely, from the sleeps you have logged, and, if you turn this on, remind you shortly before it.

3. Not medical advice

This is the most important term in this document.

• Nouri Baby is not a medical device and is not certified, cleared or approved as one by any regulator;
• It does not provide medical advice, diagnosis, monitoring or treatment. It can show where a weight falls on published growth curves, but it does not evaluate that position or tell you whether anything you record is normal or concerning;
• The figures it displays — averages, gaps, totals, charts — are arithmetic on what you typed, drawn alongside published reference curves. Neither the arithmetic nor the curves are a clinical assessment of your baby;
• The next-sleep estimate is arithmetic on the sleeps you logged: how long your baby has usually stayed awake between them. It is not a recommendation of when your baby should sleep, and it knows nothing about your baby beyond what you typed;
• It is not a vaccination schedule and never reminds you about vaccinations. It records doses you tell it were given. It does not work out when anything is due, does not tell you whether your baby is up to date, and will never notify you that something is outstanding. The schedule that applies to your child is your country's, administered by your clinic;
• The tooth eruption ages it shows are a published typical range, not a target and not a deadline. The app never marks a tooth as late, because the published ranges disagree with each other about when late would even begin;
• It must not be relied upon to detect, prevent or manage any medical condition.

Always consult a qualified healthcare professional about your baby's feeding, growth, sleep or health. If you are worried about your baby, contact your doctor or emergency services — do not consult this app, and do not delay care because of anything it does or does not show.

4. Reference data

Three published sources are reproduced in the app so that you can see your own records beside them. None of them is interpreted, and none of them is applied to your baby:

• The WHO Child Growth Standards (weight-for-age, birth to 60 months) behind the weight chart, so you can see where a weight you recorded falls;
• The American Dental Association eruption chart, for the typical age range shown against each tooth. Other health services publish ranges that differ from it by several months, which is why the app names the chart it is drawn from rather than presenting the ages as settled;
• The World Health Organization's list of vaccines recommended for all children. WHO publishes that list for countries to design their own immunization schedules from, and states in the document itself that the ages it contains “are for the development of country specific schedules and are not for health workers”. The app shows only the age that table gives for each vaccine's first dose — the one figure WHO states plainly and that holds regardless of which schedule option a country runs. It never shows a later dose's age, is never compared against what you have recorded, and is never a reason to call anything late. Your national schedule remains the one that applies.

All of it is stored inside the app and is never downloaded, so these features send nothing anywhere and work with no connection.

The World Health Organization, the American Dental Association and the American Academy of Pediatrics are not affiliated with Nouri Baby and do not endorse, sponsor or review it. Any error in how their material is presented here is ours, not theirs.

5. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse engineer, decompile, resell or redistribute the app, except where that restriction is prohibited by law.

6. Your responsibilities

• Accuracy. The app records what you enter. It cannot detect a mistyped amount or a mis-heard voice entry, so check what you save — particularly records created from speech, which the app shows you before saving for exactly this reason;
• Your clinic's record is the authority. Anything you enter here — vaccinations especially — is a personal copy kept for your own convenience. If it ever disagrees with the immunization record held by your clinic or health authority, theirs is the one that counts;
• Backups. Your records live on your device and, if enabled, in your iCloud account. Keep iCloud enabled or make your own backups. We hold no copy and cannot restore anything for you;
• Your device. You are responsible for keeping your device secure. Anyone who can unlock it can read your log.

7. Advertising

The app is free and supported by advertising served by Google AdMob. We do not control which specific ads appear and we do not endorse advertisers or their products. Ads are handled as described in our Privacy Policy.

8. Availability and changes

We may update, change or discontinue the app or any of its features at any time. We do not guarantee that the app will be available without interruption or free of defects, or that it will remain compatible with future versions of iOS.

9. No warranty

The app is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of your use of or inability to use the app. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

11. Termination

You may stop using the app at any time by deleting it. We may suspend or terminate your licence if you breach these terms. Sections 3, 8, 9 and 11 survive termination.

12. Governing law

These terms are governed by the laws of the Province of Manitoba, Canada, without regard to its conflict of law rules. Any dispute will be subject to the exclusive jurisdiction of the courts of the Province of Manitoba, Canada. This does not deprive you of the protection of mandatory consumer law in your country of residence.

13. Apple

Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Changes to these terms

Updated terms will be published here with a new date at the top. Continuing to use the app after a change means you accept the revised terms.
